    Is our government democratic or dictatorship, why allow such leaders to continue even though they have minority status and put them out

  • First thing is we must know how much time was taken by Macaulay commission to impose penal Code. if we break with the past we must consider the every change has to be weighed in golden scales for the reason human beings are habituated to past . Change could be worse remedy than the disease. If a person is imprisoned and ask him to prove prima facie that he may not be guilty laughable. Our Policemen seize the tools which may prove some light on probabable innocence. Broad question is : Is this not compulsion to give evidence against yourself against the guarantee under Article 20(2) of the constitution. It is known as testimonial compulsion in America.

    Whatever Narendra Modi does is FuckAll —- All that matters is freedom to legislate till the Government is Dropped into Exhaustion. First you ensure delay thereafter you USE the same delay to say justice delayed is justice denied and therefore the Criminal HAS to be set free !!! Utimately what is Achieved – We have extremely Rich Defence Lawyers like these three and Absolutely NO CHANGE on Ground – Crime is becoming more Macabre and at the same time extremely Sophisticated in terms of Circumventing the Judicial Process !!!   • Why Electoral Bond should be given to Political Parties. This has converted to Corruption system legally to influence the Political Parties in Power.

  • A piece of legislation can never be dissociated from its hidden agenda or motives. If means justify the ends then these highly debatable pieces of legislations lack larger democratic sanctity and moral validity. These draconian measures are bulldozed through without a proper scope for full flegded discussion and scrutiny in the parliament.In the hands of an authoritarian autocracy with its stated antagonism for individual rights and liberties these laws like all other identical versions are most likely to be used as tools of tyranny to torment more maliciously all the opposition stalwarts. Law can easily become an instrument of lawlessness when the mind presiding over it is highly malignant and potentially mischievous. These laws are not commensurate with the spirit and character of the constitutional democracy with its emphasis on personal space and freedom. Are we moving towards a police state?

    Definitely the discussion was very interesting and Mr. Rastogi highlighted certain factual issues of the judiciary countering Mr. Singhvi's statements. There lies the truth 👍

  • I feel that the erudite legal luminaries are thinking by standing in the shoes of advocates of both plaintiffs and defendants. Instead why police remad let the accused be given house arrest and available to police to interrogation from morning to evening allowing them house arrest during night.

    Its not difficult to understand what is to be done as by the SC. If it's not happening what can be done to bring change specifically in relation to the priority of cases? Is there a way out of the present situations where the process of the prosecution itself becomes the punishment! Unfortunately often times nothing gets proven after remaining in custody!

    Freedom under the Indian Constitution is more important than draconian powers and criminalising acts for the benefit of PM Modi. PM Modi needs to go to school and learn rather than rely on his fake degrees. There is no evidence against the opposition who have been imprisoned without any charges and for those criminals who have joined the BJP, the law enforcers cannot find evidence despite clear evidence.

    Wonderful discussion. We ate aware of a few matters about jurisprudence and functioning of courts etc. The pity is that lakhs os cases are pending in the courts for decades together. Priority of the case or seniority of the case is to be judged and justified. No doubt there are flaws in the system which have to be set right for cherishing of the subjects. The lawyers are to be questioned in this context are they really fighing in the courts for justice and many clients have become paupers being unable to pat the highest fee and un wanted postponement of the cases for years together. No justice no happy in larger number of cases. My opinion is thay lawyers too look in to the cases whether there is justice in thse that comes to him and then fight in the court. Simply accepting the case and forward with the twisting techniques is not fair as many clients are suffering being got their finances are emptied and agony makes him either die or run away somewhere to hide his face. And so so sirs Thank you respected sirs.

    Many provision was amended in Crpc, Ipc & Evidence. This old Act is a refined of judicial review, denuding with new Act is not wise.

    We have our own legislation not of Britain's as IPC,I e. Indian penal code, Indian evidence act,crpc 1974. So how the bjp has called Britishers law.
    Our all above laws have been amended from time to time.
    The only two reasons for making the new laws are 1/ making more stringent laws n procedures so that people may not speak against BJP government by making the police state 2/ modi may substitute ambedkar by calling him the first man who had legislated the Indian laws.Because overall no new law introduced except changing the number as 302:101 so on which will take hundred years to make an impact upon general public.
    With all that humility at my command,I will venture to submit that judiciary specially the lower use to act an clerk of police when they seek remand whether PCR or judicial.it has ruined the system.
    For your kind information the law of sk antil, given by sc after putting the longest time n energy,it's not being followed by lower courts (sessions court,) after some time.tiday is 19/6/24

    Why Kapil Sibbal and Abhishek Manu Singhvi are worried about new laws? Our Courts sit twice on the very same Saturday evening, open at midnight at their instance or give bail even when not saught for‼️ We common public can't afford them, hence our cries get burried in long waits for Justice, many a times for generations or as our President M'am described, behind bars for petty crimes just because there is no one to apply/give guarantee even for the tiny amount of the bail😢😢😢
    Instead of such discussion, please tell us how our common man's children can get selected by the collegium and chair the process of Justice in this democracy – we please don't want dynasty ruling even judiciary at the cost of taxpayers – we are paying taxes for benefit of the nation as a whole, we are not paying jazia under which we won't have right to raise our voice against the use of our money just taken forcefully……. wondering why I am telling you all this when we don't have right to tell where and how our money paid in temples after paying all taxes should be used😡🤯

    See corruption index justice index and poverty index etc. Indian laws are skewed in favour of rich and powerful. Nothing happened in Bofors, Rafael, 2G etc. lalit Modi Nirav Modi choksi mallya are enjoying life with taxpayers money. What happened to criminal law of india?
