    Did the police actually pull him over after observing him committing this act? Or did someone get his license plate number and report him? If someone just reported his truck doing that, as long as he kept his mouth shut and didn't answer ANY questions that the responding police had, there would be no way that he could be charged. Unless they had a clear picture of his face or if an eyewitness was able to conclusively identify him as the driver.

    NEVER answer questions of police, it does not help your situation, it can only hurt.

    How can targeting symbolic things be a hate crime? That's ridiculous! We had cases like this in England too, although they were nearly always released without charge. It's the police abusing their powers, over here it's private companies that bought the police, like Group 4 security, they issue fines to scam people that don't know their rights
