    All these years as a cop an doesnt know obstruction needs a physical aspect. If there isnt a physical act in it you cant be charged with it. Speech alone cannot be obstruction. These cops are why the people turning against them.

    4:01 now I’m not body shaming but I hate to see big ass cops that patrol communities cause these are the cops that arrest 1st amendment journalists for obstruction and disobeying a lawful order etc etc….Because they can’t get out their cars fast enough to physically chase real criminals down!!!!

    Interesting they admit you produce news which you post on your news channel . They retain your work product which by now contains historic news footage for reasons that just don't add up as the courts have ruled must be actively investigated no merely held by police. So when you sue that cost for lose of value of the news item contained within. Your a true journalist investigating and exposing corruption . The courts have also ruled police are not responsible for safety of reporters/ citizens in a case mirroring this one. Pure retaliation for your investigations. Pity it will brag on for years but remember to lodge an intent to sue before two years…oh you have and are happy days. Shielded by the first fourth and the other were the government takes your stuff they have to pay you for it….

    Not sure when Auditors/ jernalists are going to learn not to keep memory cards and other important items at their homes. Once used they should be sent to another trusted person and replaced with empty cards, or cards with shots of scenery so when they are seised in a warrent you don't loose a thing and the cops gain nothing.

    The U.S. Supreme Court has also ruled that police have no specific obligation to protect as person from Harm. In its 1989 decision in DeShaney v. Winnebago County Department of Social Services, the justices ruled that a social services department had no duty to protect a young boy from his abusive father.

    Obstruction is Physical act !
    Rollins ADD is not Citizens problem if he can not focus on his Job.

    Rollins needs be investigated for possible Pedophile, Spousal Abuse, Sodomy and Beastiality.

    Rollins must be Investigated by States Attorney General and Texas Rangers

The sheriff needs to go back to dog catcher he/ they are all inept at any kind of law inforcement .     Interfering or obstruction is a physical offence, not mental. This guy was not keeping you physically from doing a damn thing. If you are unfit mentally to do your job, lets get your supervisor to relieve you of duty.

    And FYI Turner vs Driver 5th circuit court already says anyone can record law enforcement in course of their duties. So case dismissed

    Depends upon the State. In some States Obstructing an Officer in the performance of his Duties must include physical violence; However, in TX according to “PENAL CODE
    TITLE 8. OFFENSES AGAINST PUBLIC ADMINISTRATION CHAPTER 38. OBSTRUCTING GOVERNMENTAL OPERATION”

    Also, admittedly this looks to be an old source (2013), so looking for more recent data, but still thought I’d share as I doubt they changed that much..😉
    However, imho (Not a Lawyer!) these are written with such broad strokes, it leaves a lot to interpretation..& very little premise for defense..(again, not a lawyer)..But, I think they were intentionally obscure..typical..

    • SUBSECTION 38.08

    Sec.A38.08.A EFFECT OF UNLAWFUL CUSTODY. It is no defense to prosecution under Section 38.06 or 38.07 that the custody was unlawful.
    Acts 1973, 63rd Leg., p. 883, ch. 399, Sec. 1, eff. Jan. 1, 1974. Renumbered from Penal Code Sec. 38.09 and amended by Acts 1993, 73rd Leg., ch. 900, Sec. 1.01, eff. Sept. 1, 1994.

    “Sec.A38.13.HINDERING PROCEEDINGS BY DISORDERLY CONDUCT. (a) A person commits an offense if he intentionally hinders an official proceeding by noise or violent or tumultuous behavior or disturbance.
    (b)AAA person commits an offense if he recklessly hinders an official proceeding by noise or violent or tumultuous behavior or disturbance and continues after explicit official request to desist.”

    “INTERFERENCE WITH PUBLIC DUTIES. (a) A person commits an offense if the person with criminal negligence interrupts, disrupts, impedes, or otherwise interferes with:
    (1)A peace officer while the peace officer is performing a duty or exercising authority imposed or granted by law;”
