Judge Aileen Cannon Hears Trump’s Motion to Remove Special Counsel Jack Smith & Toss Florida Case

Trump-appointed Judge Aileen Cannon will hold a hearing on Friday to determine if Special Counsel Jack Smith should be allowed to continue his prosecution of Donald Trump for his classified documents, obstruction of justice, and espionage crimes.

Special counsel/special prosecutors have been used in America since the 1800’s. They have always been found to be a lawful and constitutional exercise of executive branch authority.

Nevertheless, Judge Cannon – apparently ignoring both historical and legal precedent – has decided to fully litigate Donald Trump’s frivolous motion.

This video discusses what’s at stake and why Judge Cannon continues to prove that her impartially might reasonable be questioned, satisfying the legal standard for removal from presiding over Trump’s case.

    Why can’t someone file an ethics complaint to The Florida Judicial Qualifications Commission? Didn’t this or something similar in GA happen with Fani Willis and the trial is paused because of it? Why not Cannon? Maybe it would straighten her out or maybe get her to recuse?

    TO FOLLOW-UP WITH MY PREVIOUS COMMENTS DOWN BELOW :
    DOJ should have appointed as a Special Counsel an anti-corruption from Europe but a practising Prosecutor in America but it's for the better that the DOJ appointed unlawfully Smith with no Senate Vote because it gives reason to Cannon to remove him from the case and to the 11th Circuit Bench not only to validate Cannon's decision but also to deny any motion from Smith, not anymore on the case, to have Cannon removed.
    And then the DOJ will be able to appoint legally with a Senate Vote confirming the appointment a fair, impartial special Prosecutor actually practising in the US, that doesn't rush the case to skip law that matters in order to obtain conviction without considering important legal issues that would prohibit conviction, like tampering with the evidence contained in the boxes, in a biased manner.
    And all this becausr no one is above the law, including Jack Smith,
    and because
    JUSTICE MATTERS..

    Yes, it is half a truth to say that the US AG has the right, in this case, to appoint a special Prosecutor like if the AG had the choice.
    In fact, let's put things straight : the AG doesn't have the choice, not appointing is not an option in this case :
    He has the Obligation to appoint a special Counsel or Prosecutor as the AG also had the obligation to appoint a special Counsel in Biden's case which he did with Robert Hur, since Biden's and Trump's classified case are comparable and would put a regular DOJ Prosecutor in an appearance of impropriety and also the 2 cases are comparable because on appointment of both special counsels, the 2 men Biden and Trump are constitutionally presumed innocent.
    But the US judicial system also count on the AG appointing the right, competent, honest, professional and impartial Prosecutor and that Prosecutor should be appointed in the usual legal manner, that is by confirmation through a Senate Vote.
    Robert Hur was competent and impartial and his appointment was confirmed by a voice vote in the Senate. Nothing could be more transparent.
    But it is not the case with appointed special counsel Jack Smith : his appointment was never the result of a confirmation vote in the Senate and not only Jack Smith, contrarily to Robert Hur didn't appear as impartial and competent :
    The tampering of evidence with the order of documents not the same as the original in the mar-o-lago boxes is a proof of that which reversed order of documents in boxes was not allowed under Hur's supervision with the Biden's boxes but furthermore the very fact that Robert Hur was confirmed by a Senate Vote before having the Go signal from the DOJ and that it was not the case with Jack Smith proves that, arbitrarily, the procedure of having a Special Counsel approved by the Senate was skipped which calls for legitimate questioning by Trump's legal team that the Judge (Cannon) rightly took into consideration if we consider the fact that the fact that Hur was confirmed by a Senate vote was not the result of a superfluous move by the DOJ.
    So the DOJ itself confirmed the validity of the procedure of having a confirmation vote in the Senate in the appointment of Robert Hur.
    The fact that the DOJ bypassed that procedure in the appointment of Smith is a proof of inconsistency which leads immediately to the non validity of Smith's appointment. Otherwise, why having Robert Hur confirmed by a Senate Vote before he starts his investigation , so that his mandate is given to him by the Senate and that his investigation doesn't create an appeareance of conflict of interest for the DOJ. The DOJ's behavior in the appointment of Hur, fully proves that the DOJ is aware of the importance and obligation of the Senate procedure.
    And that proves that the DOJ knows they are at fault with the appointment of Smith, patriated from the Netherlands, another potential fault from the DOJ, at least as to tradition.
    So, Cannon is in the driver's seat on the case and, surprisingly for some non legally informed people like some media journalists, it's easier for
    CANNON to remove Smith from the case and better justified than it is for Smith to do the same with Cannon by appealing to the 11th Circuit and the opportunity for doing so comes to Cannon sooner since she has now Trump's team removal of Smith motion under a hearing scrutiny and that Smith is on the defensive.
    And if a reputable Judge like Raymond Dearie who had such a broad experience in classified matters was removed from this very same case as Special Master, there is no reason that Smitn, a Prosecutor, couldn't or shouldn't be removed as Special Counsel from the case with the Supreme humiliation for him of having the 11th Circuit Bench confirming Cannon's decision as they confirmed Dearie's removal earlier in the Case.
    And once removed Smith is checkmated : he has no legitimacy whatsoever and certainly not the legitimacy to appeal to the 11th Circuit to have Cannon removed after having been himself humiliated by the 11th Circuit.
    Yes the Dynamics are changing and Merchan in NY even had to step back on the Gag order and soon the US Supreme Court will smash half of Smith's Jan. 6 case, and
    the Appellate Court of Georgia will smash both
    Fanny Willis and the other Election Interference case against Trump in Georgia
    and what about the decision by the US Supreme Court on the matter of the charge of
    "Obstruction to an official proceeding" and the potential beneficial consequences for Trump in regards to the Presidential Immunity as newly framed by the Supreme Court.
    The wind is changing course and that will become even more blatant after the 1st Presidential debate.
    So Merchan and Bragg will have to be very careful with the sentencing in Manhattan, since they are working together against Trump but that they should be also working for the Democrats and BRAGGS's statements during his Election and Merchan's daughter acting during the present election campaign are a double proof of that.
    So a suspended sentence most probably
    as Alan Dershowitz predicted for the 11th of July in Manhattan and may be people will talk again with Dersh in
    Martha's Vineyard and pay respect to the Emeritus Professor.

    One would think that this latest debacle of Judge Cannon would be the final trigger for Jack Smith to go to the 11th circuit and get Judge Cannon removed from this case and a more experienced Judge put in charge of this case and get Trump finally convicted.

    The rules for nominating a special counsel are not the same in 2024 as they were in the 19th century so what was legal in the 19th century is not necessarily legal today. All recent special counsels have been US attorneys meaning they were nominated by the president and approved by Congress. John Durham carried the power of his congressional commission . Smith was never nominated by the president to be a US attorney nor was he approved by Congress for any position.

    I think the thing Judge Cannon should do is send this to the 11th and let them hash it out. No matter how she rules it will be appealed anyway. And once in the Appellate process both cases that smiith is part of will have to be put on hold.

    Still waiting for accountability in Montana. I sure didn't have to wait for my accountability when I was in front of the judge. I didn't get to run around the country, I was charged with a lesser charge and did 3 months. And Joe Arpaio did no time and was granted pardon from Trump. I was in a rollover and put a palm branch through my head. I became homeless and an addict. I have seen how corrupt the legal system and law enforcement apply corrupt abuses on homeless people. I left Arizona and moved home. I have not received even a parking ticket in 24 years. I find it appalling that Phoenix is just waking up to the corruption. Still waiting in Montana for accountability 😢!

    What about her is a partisan as compared to the judges, NY AG , and NYC DA when the AG ran on the Democratic line in the state and was funded by the Donations from Democrats. Or, the judges in NYC who were selected by the Democrat party leaders and ran for office unopposed funded by almost the same donors. You call that a fair process. Honestly, you have a strange sense of fairness. Glad you are not a prosecutor anymore. Classic arrogance of someone who needed a title to be effective. The question presented is whether he was properly appointed. Not whether a Federal Judge genuflects to someone who, like Judge Dread , declares “I am the Law.” Your partisanship has served you well on YouTube.

    Donald Trump may also be the most masterful obstructor of justice in our nation's history. He was pretty clever when he gave Aileen Cannon her lifetime appointment – to his home district of Mar a Lago, of course – knowing that it would become the scene of the crime. In other words, Trump covered his @$$ as he walked out the door of the White House, taking those top secret documents with him.

    As much as I dread the outcome of Judge Cannon's ruling, and she may delay yet again to issue a ruling on Friday's hearing, I think that will definitely be the final straw for Special Counsel Smith to not only force Cannon to recuse herself but to get her removed from the Bench. Because of her blatant bias, Cannon's removal as a Judge is long overdue.

    Glenn, we are not simply looking to convict a street drug dealer and give the guy a year or two and call it a day. We are discussing the reputation of Trump, the future US president. Judge Aileen Cannon should proceed with caution and prioritize ensuring a fair outcome.
