    What I really hate about hung juries is that the financial hardship it causes the defendant, if they are innocent and the state retries them. I still think there is reasonable doubt.

    How many days of testimony was on the Albert’s time at the kid’s basketball game before going out to drink? How much was centered around McCabe’s phone? All the time before the prosecution ever got to the theory of how John was killed or even the Medical examiner’s testimony. All the defense needed was three experts to show he wasn’t hit by a car.

    I find it wild you don’t get the full transcript. We in aus (at least in the a.c.t) get one physical copy and one digital copy.

    We also take notes, but the transcript was essential. I was able to go back through the transcript and prove that he lied due to having it. I was able to remember the lie and half the others vaguely remembered it (I was correct nearly word for word lol) and showing it in the transcript was able to convince the others.

    Honestly if i agreed we were hung being given this now would piss me off.
    Being sent back soo much before this would really annoy me.
    I wouldn't hang a jury unless i truly felt conviction on my decision.

    If I were told this instruction under your circumstances I’d really, really look to see if there was any way I could change from m GUILTY to NOT GUilTY . Most likely change if I’m the only holdout.
    I would never be able to change if I was voting guilty!!

    Found this channel back in the JD/AH case.

    @23:00 I had that experience in primary school at anout 8 y/o. A police officer was explaining a road rule to us and then gave an example and asked the class if car A gives way to car B. I knew a real world road that went like that so I knew the correct answer but on the first vote the class was split 50/50. It was a bit of a trick question where two rules conflicted, and you had to follow them in the correct order.
    So the officer talked a bit, and questioned the class a bit, and a second vote was cast. This time it was more like 3/4 for car A, and 1/4 for car B. The offcier goes something like "are you sure?" and holds a third vote. Only myself and one other kid held out, and when we gave our answer other kids were telling us to put our hands down. It's a lot of pressure to follow the crowd, especially as a young kid. No one wants to be the only kid or kids to get the answer wrong. But I and the other kid had confidence and in the end it was revealed that we were in fact correct. 😊
    Peer pressure is a hell of a thing, but I'm grateful that I'm not the type to be easily swayed by it. 😊

    We have incompetent jurors because SO MANY sane people try their hardest to get OUT of jury duty!! Think about that? If people just did their civic duty we would have a stronger judicial system! GO TO JURY DUTY!!

  • I heard rumors that there was one or two attorneys on the jury like I said just a rumor but the way these notes have been written. Makes me wonder if they’re really was.

  • Yeah, 29 days of testimony, but they’re supposed to remember all of that without any transcripts or read backs. I don’t care how good my notes were. I would not be able to remember every single person that testified.

    25:02 If i were a juror hearing this instruction, it would not necessarily make me change my opinion on the verdict. However, I would go back and honestly reconsider my conclusions and understanding of the evidence and try to truly listen more openly to the other jurors' opinions. Basically, I would try to earnestly and honestly re-evaluate my opinions for flaws and go from there. I would like to think that I would absolutely do everything in my power to stand by what I feel is the right verdict according to the evidence and law. Even if I were to be the only one who felt that way after an honest and sterile re-evaluation.

    Furthermore, if I come to understand that there is a true flaw in my reasoning, I would not hesitate to admit that and even change my verdict if I thought I was in the wrong initially. The seriousness of the duty calls for nothing less when lives are on the line. Heavy burden.
